Background
At its meeting on 22 April 2025, Council resolved to put the Draft Local Approvals Policy on public exhibition.
What is the Draft Local Approvals Policy?
The Local Approvals Policy sets out guidelines and requirements for how Council will assess and determine applications for certain activities that require Council approval under Section 68 of the Local Government Act 1993 (the Act).
The Policy supplements provisions of the Act and the Local Government (General) Regulation 2021 (the Regulations) by:
Part 1: Specifying the circumstances in which a person would be exempt from the requirement to obtain a particular approval of Council;
Part 2: Specifying the criteria which Council must take into consideration in determining whether to give or refuse an approval; and
Part 3: Specifying other matters relating to approvals
The Policy seeks to:
Guide applicants requiring approval for an activity under section 68 of the Act within The Hills Local Government Area
Specify the criteria that Council staff will take into consideration in determining applications for approval under the Act
Specify any other matters relating to the approvals process under the Act.
The Local Approvals Policy seeks to provide criteria for approval, exemptions and prohibitions for:
Placing waste storage containers (skip bins) in a public place;
Placing waste storage containers (recycled clothing bins) in a public place;
Installing or altering a waste treatment device or a human waste storage facility (on-site sewage management systems);
Operation of on-site sewage management systems;
Using a standing vehicle or any article for the purpose of selling any article in a public place (mobile food vans and temporary food stalls);
Installing a domestic oil or solid fuel heating appliance (wood fire heaters); and
Busking, use of a loudspeaker, delivering a public address, religious service or public speaking on community land.
