What is proposed?
We have received an application for:
A Section 4.56 Modification to an Approved Extractive Industry.
The consent authority for the Modification Application is The Hills Shire Council.
What is the application for?
In accordance with Clause 56 of the Environmental Planning & Assessment Regulation, 2021, notice is hereby given that Council is in receipt of Modification Application No. 77/1996/HE/B from PF Formation Pty Ltd. The site is subject to Land and Environment Court Consent Orders 10064 of 1998.
The development is defined as a “Designated Development” under Schedule 2 of the Environmental Planning and Assessment Regulation, 2021.
The proposed Modification Application seeks:
- To extend the consent for the staged extraction of material and rehabilitation until 30 November 2038 consistent with the Hitchcock Road Sand Project State Significant Development Consent 06_0104; and
- To allow the import of Virgin Excavated Natural Material (VENM) and Excavated Natural Material (ENM) and material approved under an Environment Protection Authority (EPA) resource recovery exemption order, for possible processing of VENM, backfilling of the extraction area and rehabilitation works.
The Modification Application is available for public inspection from 22 April 2025 to 26 May 2025 at the following places:
• On-line on Council’s website using the Application Tracking tab and Modification Application No. 77/1996/HE/B; and
• In person at Council’s Customer Service Centre, 3 Columbia Court, Norwest.
Council has an online development application enquiry system to view plans and details and to monitor progress of this application. This can be accessed by visiting Council’s website www.thehills.nsw.gov.au and clicking on the “Building and Planning” tab and selecting the “Application Tracking” option. You can also lodge an “e-Submission” using this facility.
Any person may make a submission in writing to Council in relation to the modification application, and where a submission is made by way of an objection the grounds of that objection must be specified. Submissions are to be received no later than 26 May 2025.
Any person who makes a submission by way of an objection and who is dissatisfied with the determination may appeal to the Land & Environment Court in accordance with the Environmental Planning and Assessment Act, 1979. However, if an Independent Planning Commission public hearing is held, the Commission’s determination of the application is final and is not subject to Appeal.
