What is proposed?

We have received an application for a Section 4.55(2) Modification to an Approved Designated, Nominated Integrated, Integrated and Threatened Species Development - Extractive Industry (Sandstone Quarry).


The consent authority for the Modification Application is The Hills Shire Council.


What is the application for?

In accordance with Clause 56 of the Environmental Planning & Assessment Regulation, 2021, notice is hereby given that Council is in receipt of Modification Application No. 310/2003/HE/B from Barker Ryan Stewart on behalf of Gosford Quarries.

The development is defined as a ‘Designated Development’ under Schedule 3 of the Environmental Planning and Assessment Regulation, 2021.

The original Development Application limited extraction on the site to a period of 20 years, being until 7 August 2023, with an additional two year period after cessation of the extraction period for the completion of rehabilitation works. A subsequent Modification Application granted approval for an extension of time for extraction until 7 August 2025, with an additional two year period of time for the completion of rehabilitation works.

The proposed Modification Application seeks to allow extraction for an additional two year period.

The original development was also classified as Nominated Integrated Development and Integrated Development under the provisions of Section 91 of the NSW Environmental Planning and Assessment Act, 1979 since the development also requires approval / concurrence from the NSW Department of Land and Water Conservation pursuant to the provisions of Part 3A of the Rivers and Foreshores Improvement Act 1948 and the Water Act 1912 (Water Management Act); and the NSW Environment Protection Authority pursuant to the provisions of the Protection of the Environment Operations Act 1997.

The original development was also classified as a ‘threatened species development’ and included a Species Impact Statement (SIS).

Note: Section 91 of the NSW Environmental Planning & Assessment Act, 1979 is now Clause 4.46 and the relevant authorities are the NSW Department of Planning and

Environment – Water under the provisions of the Water Management Act 2000 and the NSW Environment Protection Authority under the Protection of the Environment Operations Act, 1997.

The Modification Application and supporting documents are available for public inspection from 14 May 2025 to 16 June 2025 at the following places:

  • In person at Council’s Customer Service Centre, 3 Columbia Court, Norwest.
